Your bankruptcy may be simple or complex. Either way, filing for bankruptcy can be a complicated and intimidating process. Many attorneys steer their clients towards Chapter 13 bankruptcy because we, as attorneys, typically make more on Chapter 13 cases. I prefer the a simpler, quicker and less expensive Chapter 7 for my clients whenever possible.
Chapter 7 typically costs less than a third of a Chapter 13. Most Chapter 13's take 5 years, most Chapter 7's take about 4 months. Most people qualify for FHA financing just 2 YEARS after filing Chapter 7, a person who filed Chapter 13 would typically have one to three years remaining in their bankruptcy. We pride ourselves on working hard to get our clients to qualify for Chapter 7. However, Chapter 13 is the right choice for some debtors. If we recommend Chapter 13 you will get a detailed explanation why you don't qualify for Chapter 7.
We have worked hard to make the bankruptcy process as simple as possible. You will do your consultations (with an attorney not a paralegal) on the phone or via Zoom. You will provide the information and documents we need to prepare your bankruptcy online. You will sign your bankruptcy documents electronically. The court hearing ("341 meeting", or "Meeting of Creditors") that all debtors must participate in will be done via Zoom. There are exceptions, but most likely you won't have to appear in court at all. Most likely we will not meet in person. However, we will develop a relationship.
Bankruptcy can be complicated. Some people make too much money to qualify for Chapter 7 or have assets they would lose in Chapter 7. We work very hard to get our clients to qualify for Chapter 7 and keep all of their assets. If you have been told that you make too much money and don't qualify for Chapter 7 give us a call so that we can give you our opinion.
Most people in Snohomish County can protect up to $780,000.00 of equity in their home ... but not everyone. It you have equity in your home it is important that you consult with an attorney who understands how the homestead exemption works.
If a client doesn't qualify, or would lose assets in Chapter 7, we work hard to minimize their Chapter 13 payments.
